OVERVIEW

Welcome to Lune and Linen.

The terms “we”, “us” and “our” refer to Lune and Linen, a business registered in the Netherlands under company number (KvK) 99215535.

Lune and Linen operates this website and online store, including the information, content, features, tools, products and services made available through it (collectively, the “Services”). Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access our website or purchase from Lune and Linen.

Please read these Terms carefully before using the Services.

By accessing or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree with these Terms, you should not use the Services.

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, including rights available to Australian consumers under the Australian Consumer Law.

SECTION 1 - ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your place of residence or that you have permission from a parent or legal guardian where required.

To use certain features of the Services or place an order, you may be asked to provide information including your name, email address, billing details, payment information and shipping address.

You agree that the information you provide is accurate, current and complete and that you are authorised to provide that information.

If you create an account, you are responsible for maintaining the confidentiality and security of your login credentials and for activity carried out through your account.

You may not use the Services for any unlawful or fraudulent purpose.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, specifications, photographs, colours, dimensions, configurations and other information displayed on our online store accurately represent the products offered for sale.

Product colours and appearance may vary slightly depending on factors such as your device, screen settings, lighting and photography.

Please review the product description, dimensions, selected colour and selected configuration carefully before placing your order.

Unless expressly stated otherwise, jewellery, accessories and other styling items shown in product or lifestyle photographs are for display purposes only and are not included with the product.

We may update product descriptions, product ranges or availability from time to time. We may also discontinue products or limit sales to particular geographic areas where reasonably necessary.

Any such changes will not affect consumer rights relating to orders that have already been accepted.

Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

SECTION 3 - ORDERS

When you submit an order, you are making an offer to purchase the selected products.

Your order is accepted once we have successfully processed or authorised payment and confirmed acceptance of the order.

We may decline or cancel an order where there is a legitimate reason to do so, including where:

  • a product is unavailable;

  • payment cannot be authorised;

  • an obvious pricing or product-information error has occurred;

  • the delivery address cannot reasonably be serviced;

  • we reasonably suspect fraudulent or unauthorised activity; or

  • accepting the order would breach applicable law.

If we cannot accept an order after payment has been taken, we will notify you using the contact details supplied with the order and provide an appropriate refund.

Please review your order carefully before submitting it.

If you wish to change or cancel an order, contact us as soon as possible at customer@luneandlinen.com. We will make reasonable efforts to assist, but we may not be able to modify or cancel an order once processing or fulfilment has begun.

Returns, exchanges and refunds are handled in accordance with our Return & Refund Policy and any rights available to you under applicable consumer law.

Purchases made through our consumer storefront are intended primarily for personal or household use unless otherwise agreed with us.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions may change from time to time.

The price applicable to your purchase will be the price displayed when you place your order and confirmed during checkout and in your order confirmation.

Prices for customers shopping through our Australian store are displayed in Australian dollars (AUD) unless otherwise indicated.

We currently offer free standard shipping on orders delivered within Australia, as further described in our Shipping Policy.

Any applicable taxes, duties or other charges for which you are responsible will be disclosed where required by applicable law and where relevant to the transaction.

We will not add undisclosed Lune and Linen shipping charges to an order after you have completed checkout.

You agree to provide current, complete and accurate billing, payment and contact information.

You represent that you are authorised to use the payment method selected during checkout.

Payments are processed using the payment providers available through our checkout. Further information is available in our Payment Policy.

SECTION 5 - SHIPPING AND DELIVERY

Lune and Linen is a Netherlands-registered business serving customers in Australia.

Orders are fulfilled on our behalf by our third-party fulfilment partner and are dispatched from our third-party fulfilment warehouse in Yiwu, Zhejiang, China.

Our current standard shipping arrangement for Australia is:

  • Processing time: 1–2 business days

  • Transit time: approximately 7–13 business days

  • Estimated total delivery time: approximately 8–15 business days

  • Standard shipping: free within Australia

Delivery timeframes are estimates rather than guarantees.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, public holidays, customs processing, extreme weather or disruptions to transport networks.

Lune and Linen remains your retailer and point of contact regarding your order, even where delivery or fulfilment is carried out by a third-party provider.

If your order is significantly delayed, lost or damaged in transit, please contact us so that we can investigate and provide an appropriate resolution.

Nothing in this section excludes or limits any right or remedy available under applicable consumer law.

SECTION 6 - INTELLECTUAL PROPERTY

Unless otherwise indicated, the content made available through the Services, including our branding, text, graphics, website design, product descriptions, photographs, videos and other materials, is owned by or licensed to Lune and Linen and is protected by applicable intellectual property laws.

You may access and use the Services for lawful personal and non-commercial purposes.

Unless permitted by applicable law or authorised by us in writing, you must not reproduce, distribute, modify, republish, commercially exploit or create derivative works from material owned by Lune and Linen.

Nothing in these Terms transfers ownership of any intellectual property to you.

The Shopify name and associated trademarks belong to Shopify or its relevant affiliates. Other third-party names and trademarks remain the property of their respective owners.

SECTION 7 - OPTIONAL THIRD-PARTY TOOLS

We may provide access to features, applications or tools operated by third parties.

These third-party services may operate under their own terms and privacy policies.

We do not control every aspect of third-party services and cannot guarantee their continuous availability or performance.

Your use of optional third-party services may therefore also be subject to the relevant provider's terms.

Nothing in this section excludes any responsibility that Lune and Linen cannot lawfully exclude.

The Services may contain links to websites, applications or resources operated by third parties.

These links may be provided for convenience or informational purposes. Unless expressly stated otherwise, the presence of a link does not mean that Lune and Linen controls or endorses the third-party website or its content.

To the maximum extent permitted by applicable law, Lune and Linen is not responsible for losses arising solely from your independent dealings with an unrelated third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Our online store is powered by Shopify, which provides the ecommerce technology used to operate the store and checkout.

Products purchased through the Lune and Linen store are sold to you by Lune and Linen, not Shopify.

Lune and Linen remains responsible for its obligations to customers as the retailer, including obligations relating to the products we sell and applicable consumer rights.

Shopify may process certain information in connection with providing its platform and payment-related services. Please refer to our Privacy Policy for further information.

SECTION 10 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify and relies on other service providers, personal information may be processed by Shopify and other parties involved in operating our store, processing payments, fulfilling orders and arranging delivery.

Some of these providers may operate in countries other than the country in which you live.

SECTION 11 - FEEDBACK AND REVIEWS

If you voluntarily submit product reviews, comments, suggestions, photographs, feedback or other content to us (“Feedback”), you confirm that you have the right to provide that Feedback.

Unless otherwise agreed, you grant Lune and Linen a non-exclusive, worldwide, royalty-free licence to use, reproduce and display your Feedback for legitimate business purposes, including operating, improving and promoting our Services.

You must not submit Feedback that:

  • is knowingly false or misleading;

  • is unlawful, defamatory, threatening or abusive;

  • contains malicious software; or

  • falsely represents your identity or relationship with another person.

Where you have received compensation or another incentive in connection with Feedback, you must disclose this where required.

We may moderate or remove Feedback where reasonably necessary for legal, security or platform-integrity reasons.

If a material error affects an order that you have already placed, we will contact you where appropriate and provide a reasonable solution. Where we cannot fulfil an accepted order, any amount paid for the affected product will be refunded as appropriate.

Termination of website access does not remove any rights or obligations relating to an order that has already been accepted, nor does it limit rights that cannot lawfully be excluded.

Sections that by their nature should continue following termination will remain effective.

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, condition, right or remedy that cannot lawfully be excluded or restricted.

For Australian consumers, this includes applicable rights and consumer guarantees under the Australian Consumer Law.

Products supplied to consumers are subject to the consumer guarantees that apply under relevant law, including where applicable guarantees concerning acceptable quality, fitness for purpose and correspondence with descriptions.

Separate from those statutory rights, we do not guarantee that access to our website will always be uninterrupted or completely error-free.

General informational material made available through the website is provided for informational purposes and should be considered in the context in which it is presented.

Any exclusion or limitation contained in these Terms applies only to the maximum extent permitted by applicable law.

SECTION 16 - LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies liability where doing so would be unlawful.

In particular, nothing in these Terms limits any right to a repair, replacement, refund, compensation or other remedy that you may have under applicable consumer law, including the Australian Consumer Law.

To the maximum extent permitted by law, Lune and Linen will not be liable for indirect, incidental or consequential losses arising solely from use of the website where such losses were not reasonably foreseeable and may lawfully be excluded.

Any limitation of liability in these Terms is subject to all non-excludable statutory rights.

SECTION 17 - YOUR RESPONSIBILITY FOR MISUSE

You are responsible for losses reasonably suffered by Lune and Linen as a direct result of your fraudulent, unlawful or deliberately unauthorised use of the Services, or your infringement of the rights of another person through the Services, to the extent permitted by applicable law.

This section does not require you to compensate Lune and Linen for losses caused by our own acts, omissions, negligence or breach of law.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply to the maximum extent permitted by law or, where necessary, will be severed.

The remaining provisions will continue to apply.

If we do not immediately exercise or enforce a right under these Terms, that does not mean that we waive that right.

These Terms, together with the policies expressly incorporated or referenced in them, form the agreement governing your use of the Services.

Nothing in this section limits representations, guarantees or rights that cannot lawfully be excluded.

You may not transfer your contractual rights or obligations under these Terms to another person without our consent where our consent is reasonably required.

Lune and Linen may transfer its rights and obligations in connection with a genuine sale, restructuring or transfer of the business, provided that doing so does not remove or materially reduce any non-excludable rights you have in relation to an existing order.

These Terms are governed by the laws applicable to Lune and Linen in the Netherlands, subject to any mandatory laws that apply to you as a consumer.

If you are a consumer in Australia, nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or other consumer protections that cannot lawfully be excluded.

Nothing in this section prevents you from exercising a right to bring a claim in a jurisdiction available to you under mandatory applicable law.

The headings used in these Terms are provided for convenience and do not affect the interpretation of the Terms.

We may update these Terms from time to time to reflect changes to our Services, business operations, applicable law or regulatory requirements.

Where required by law, we will provide appropriate notice of material changes.

Changes to these Terms will not retrospectively remove consumer rights or contractual rights relating to an order that was already accepted before the change took effect.

Your continued use of the Services after updated Terms take effect constitutes acceptance of those updated Terms to the extent permitted by applicable law.
